An overview of wrongful death claims

On Behalf of | Nov 18, 2015 | Fatal Motor Vehicle Accidents, Firm News

When someone dies in an accident, the victim’s family members can sue the responsible party for wrongful death. The family members may then be able to obtain financial compensation for their loss.

As a first step, one of the attorneys from our firm will listen to your story and explain your options. If you decide to pursue the wrongful death claim, we will work aggressively and effectively for you and your family. We understand how difficult this time is, and we want you to know that we will be on your side every step of the way.

Under Connecticut law, a wrongful death claim can be filed only by the personal representative of the victim’s estate. In order for the claim to be successful, the representative must be able to prove the following elements:

  • That the victim’s death was caused by another person’s negligence or intent to cause harm; and
  • That the surviving family members suffered some financial injury as a result of victim’s death

If these elements can be proven, the family members may be entitled to damages. Damages are intended to compensate the family for both economic and non-economic losses. Examples of economic losses include funeral expenses and lost wages.

Examples of non-economic losses include loss of services and loss of companionship.Wrongful death claims can arise out of many different circumstances. Many arise out of fatal accidents, including auto accidents, hit and run accidents, motorcycle accidents, and truck accidents.  Wrong death claims can also arise out of negligent acts such as medical malpractice and exposure to hazardous substances.

Losing a family member is a very painful time. If you and your family want to file a wrongful death lawsuit, consider hiring an attorney. An attorney who has experience in wrongful death claims can help you understand your options and secure maximum compensation for your loss.

At Jacobs & Dow, LLC LLC, we provide compassionate and skilled representation for families who lost a loved one in a fatal accident.
