After a fatal wreck can I sue for a sudden loss of companionship?

Losing a companion in a fatal accident is, understandably, devastating. When such an accident occurs due to the negligence of another, surviving family members may have legal recourse. Along with seeking relief for any financial losses experienced as a result of the accident, in the state of Connecticut it may be possible to seek compensation for the sudden loss of companionship as well.

A wrongful death lawsuit can generally be filed by a surviving spouse, child and immediate family members. Such a claim is typically brought by whomever is assigned to managed the decedent’s estate, though. A wrongful death suit may be filed in an attempt to seek damages for any personal losses that the decedent experienced before his or her death — such as pain and suffering and expenses. Along with the losses suffered by the decedent, any damages sustained by surviving family members — such as monetary losses — may also be sought.

One thing that some may not realize is that compensation for psychological needs can also be collected. Wrongful death suits go beyond the loss of money. These tragedies are emotionally damaging. So family members may also seek compensation for their emotional suffering.

A lot goes into filing a wrongful death lawsuit in Connecticut. Certain elements must be met for such claims to be successful, including providing proof of negligence and documented financial and emotional losses. The sudden loss of companionship is difficult for anyone to cope with, and taking legal actions after such a tragedy may seem to be too much to handle. However, by taking this step, financial relief can be awarded if litigation is successful, which may allow surviving family members the ability to seek the help they need as they strive to move forward.
